Terms of Use

In brief. SeeU is provided free of charge and is available to users aged 16 and over. You retain the rights to the content you publish; you merely permit us to display it. Harming people and breaking the law are prohibited: for such conduct we remove material and block accounts. You may delete your account at any time.

1. General provisions

1.1. These terms (the “Terms”) constitute an agreement between the owner of the SeeU service (“we”, “us”) and you, an individual using the SeeU mobile app and the seeu.kz website (together, the “Service”). Details of the owner are published on the Legal information page.

1.2. The Terms are a contract of adhesion. By registering with or beginning to use the Service, you confirm that you have read the Terms and accept them in full. If you do not agree with the Terms, do not use the Service.

1.3. The Privacy Policy, the Community Guidelines and the other documents published under Legal information form an integral part of the Terms.

2. Definitions

  • Account: your user account in the Service, linked to a phone number.
  • Profile: your page in the Service, which combines your posts and a private space for messages and calls.
  • Card: an anonymous card consisting of a photo, text and, at the owner’s choice, a music track, visible to nearby users of the scanner.
  • Warmth: a sign of attention that may be sent to the owner of a card.
  • Access: mutual permission between two users for private messaging and calls.
  • Content: any material in the Service, including texts, photos, videos, audio recordings, messages and broadcasts.

3. Eligibility

3.1. The Service may be used by persons aged 16 and over. If you are 16 or 17, you use the Service with the consent of a parent or other legal guardian and confirm that such consent has been obtained. The detailed conditions are set out in Age and child safety.

3.2. Each user may hold only one account. Registering on behalf of another person, and transferring or selling an account, are prohibited.

3.3. Persons whose account we have previously blocked without the right of restoration may not use the Service.

4. Account

4.1. You sign in to the Service with your phone number and a one-time code. You are responsible for ensuring that only you have access to your number and device. We will never ask you for your confirmation code.

4.2. Your profile must contain a genuine name and username; impersonating another person or organisation is prohibited.

4.3. If you suspect that another person is using your account, notify us immediately at support@seeu.kz.

4.4. You may delete your account at any time in the app’s settings. The consequences of deletion are described in Delete your account and data.

5. Features of the Service

5.1. The Service allows you to maintain a profile and publish content, exchange messages and calls with users with whom you share access, find people nearby using the scanner and exchange warmth, communicate in rooms and meetups, host live broadcasts, listen to and publish audio in Audio, and take photos and videos with effects.

5.2. Certain features of the Service are designed to protect users: messaging is possible only with mutual access, every view of a card is visible to its owner, and the amount of warmth is limited. These rules form part of the Service and must not be circumvented.

5.3. The Service is provided free of charge. Should paid features be introduced, their terms will be published separately before sales begin; payment for such features will not be a condition for using the rest of the Service.

5.4. We develop the Service and may add, change or remove features. We will give advance notice of material changes affecting your content or data.

5.5. The Service requires an internet connection and a compatible device. You bear the cost of your connection at your carrier’s rates.

6. User content

6.1. You retain the rights to the content you create.

6.2. By publishing content in the Service, you grant us a free, non-exclusive, worldwide licence, valid for as long as the content remains in the Service, to store, reproduce, process (for example, to compress video or create previews), display and make the content available to the audience you have chosen. The licence is required solely for the operation of the Service. We do not sell your content or use it in advertising without your separate consent.

6.3. The licence terminates when you delete the content or your account, subject to the periods for deletion from backups and except where the content has already been forwarded or saved by other users or must be retained by law.

6.4. You warrant that you hold the rights to the content you publish, including music and photos and videos of other people, and that the content does not violate the law or the Community Guidelines. Should these warranties be breached, you bear responsibility.

6.5. The publication of photos and videos depicting other people requires their consent. Filming people without their knowledge, or publishing images of them in order to humiliate or harass them, is prohibited.

7. Prohibited conduct

7.1. The Service maintains zero tolerance for objectionable and dangerous content and behaviour. Everything listed in the Community Guidelines is prohibited, including:

  • any sexual material involving minors, and their exploitation or grooming;
  • threats, bullying and harassment, including of people found by means of the scanner;
  • incitement to violence, terrorism, extremism or hatred;
  • the sale of prohibited goods, fraud and spam;
  • publication of other people’s personal data or images without consent;
  • infringement of copyright and other rights.

7.2. It is further prohibited to circumvent the Service’s restrictions (mutual access, limits on warmth, blocks), to collect user data by automated means, to spoof scanner signals, to interfere with the operation of our servers, and to decompile the app, except where expressly permitted by law.

8. Moderation and restrictions

8.1. Any user may report content or an account and block another user. Reports are reviewed by moderators in accordance with the established procedure.

8.2. In the event of a breach of the Terms or the law, we may remove content, restrict features, or suspend or permanently block the account. The choice of measure depends on the seriousness of the violation and whether it has been repeated. We inform you of our decision unless this would hinder an investigation or is prohibited by law.

8.3. A decision may be appealed within 30 days in the app: Settings (Настройки) → “What is happening with my account” (Что с моим аккаунтом). If you do not have access to the app, send the appeal to support@seeu.kz.

8.4. We report material involving the sexual exploitation of children, threats to life and other serious crimes to law enforcement authorities.

9. Rights in the Service

9.1. The app, the website, the design, the SeeU name and logo, the camera effects and other elements of the Service belong to us or are used by us on lawful grounds.

9.2. We grant you a limited, non-exclusive, non-transferable licence to use the app on your own devices for personal, non-commercial purposes in accordance with the Terms. Any other use (copying, modification, distribution or sale) requires our written consent.

9.3. We may use any ideas and suggestions you send us without any obligation to you.

10. Liability

10.1. We endeavour to keep the Service running without interruptions or errors, but we cannot guarantee this: maintenance work, connection failures and errors may occur. The Service is provided “as is”.

10.2. We are not responsible for the content or actions of other users, including in-person meetings that take place after people have met through the Service. We nevertheless respond to reports and assist law enforcement authorities.

10.3. To the extent permitted by law, we are not liable for lost profits or indirect losses. Nothing in the Terms limits the rights granted to you by consumer protection legislation that cannot be limited by contract.

10.4. You are responsible for your content and actions in the Service and shall compensate us for losses arising from your breach of the law or the Terms.

11. Termination

11.1. You may terminate the Terms by deleting your account.

11.2. We may terminate the Terms with respect to you by blocking your account for violations, or discontinue the Service as a whole, giving users at least 30 days’ notice where possible.

11.3. Provisions which by their nature are intended to survive termination (those concerning liability, rights in the Service and the resolution of disputes) remain in force.

12. Changes to the Terms

We may amend the Terms. We notify users of material changes in the app at least 10 days before they take effect. Continued use of the Service thereafter constitutes acceptance of the new version. If you do not agree with the new version, you should stop using the Service and delete your account.

13. Governing law and dispute resolution

13.1. The Terms are governed by the law of the Republic of Kazakhstan.

13.2. Claims are to be sent to legal@seeu.kz and are reviewed within 30 days. If a dispute cannot be settled out of court, it shall be heard by a court of the Republic of Kazakhstan in accordance with the rules of jurisdiction established by law. Consumers may bring a claim before the court of their place of residence.

14. Terms for users of Apple devices

If you downloaded the app from the App Store, the following terms also apply:

  1. These Terms are concluded between you and us only, and not with Apple Inc. (“Apple”). We, not Apple, are solely responsible for the app and its content.
  2. The licence granted to you for the app is limited to use on any Apple-branded products that you own or control and as permitted by the Usage Rules set forth in the App Store Terms of Service.
  3. We are solely responsible for providing any maintenance and support services for the app. Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the app.
  4. In the event of any failure of the app to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the app, if any, to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the app, and any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty will be our responsibility, to the extent provided by these Terms and the law.
  5. We, not Apple, are responsible for addressing any claims by you or any third party relating to the app or your possession and/or use of it, including product liability claims, claims that the app fails to conform to any applicable legal or regulatory requirement, and claims arising under consumer protection, privacy or similar legislation.
  6. In the event of any third-party claim that the app or your possession and use of it infringes that third party’s intellectual property rights, we, not Apple, will be solely responsible for the investigation, defence, settlement and discharge of any such claim.
  7. You represent and warrant that you are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a “terrorist supporting” country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.

  9. You must comply with applicable third-party terms when using the app, such as your wireless data service agreement.
  10. Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of the Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce the Terms against you as a third-party beneficiary.
